Potential Liability and Legal Challenges Facing those who make Safety Decisions

 
About the Presentation

Anyone who makes safety decisions, or manages safety as part of their normal job duties, may literally make life and death decisions every day. This session will provide an overview of the potential personal liability and legal concerns faced by those who manage safety and make safety decisions that impact others. We will review incidents where legal action may have been brought due to alleged negligence or willful safety violations, what kind of legal and financial protection your company may provide for you, what insurance and financial steps you can take on your own to protect you and your family provide, and discuss ethics and what standards of care you may be held to in making those safety decisions.

Matthew N. Olphin, CSP, ARM (Vice President, Risk Control Service) Matt has 22 years of insurance industry experience and earned a B.S. degree in Occupational Safety & Hygiene Management from Millersville University. He joined Murray Securus in 1999. Matt manages the risk control department and provides services to clients in a wide range of industries. He has earned the Certified Safety Professional (CSP) and Associate in Risk Management (ARM) designations. He is a member of the National Fire Protection Association, the Lancaster County Industrial Safety Council, the American Society of Safety Engineers (ASSE) and he is Past President of the Central PA ASSE Chapter.

Amy Mitchell, CIC, CISR, (Vice President, Commercial Solutions) Amy collaborates with businesses to know their industry and assist in developing a risk management and insurance program to help them be safer and more secure. She partners with businesses to advise and advocate on their behalf to provide the most comprehensive insurance coverage at the best available price. Her expertise is in hospitality with emphasis on workers' compensation, general liability, property, automobile, employment practices and cyber liability. Amy holds the Certified Insurance Counselor (CIC) and Certified Insurance Service Representative (CISR)

Jim Devine  
Presenter Biography

Jim is a graduate of Franklin & Marshall College and the University of Pittsburgh School of Law. Jim has successfully litigated workers’ compensation and employment cases since 1993. His broad range of experience allows him to provide his clients with effective analysis of the liability risks and costs associated with each case.  Jim’s expertise extends to include the interplay between the Americans with Disabilities Act, the Family Medical Leave Act, and employment law concerns surrounding discipline and discharge and drug and alcohol abuse.

Furthermore, Jim has extensive experience defending employers in EEOC and PHRC claims. In addition to maintaining a full case load, Jim is a popular speaker, lecturing throughout the year on current employment law issues, such as discrimination, harassment, internet policies, and the maintenance of an aging workforce.  Jim also provides in-house training for insurance carriers and specialized employers, such as hospitals, by keeping staff updated on case law and other issues resulting from legislative updates to the ADA, FMLA, EFCA, HIPAA and COBRA.

Jim is passionately committed to his family and his community, volunteering in church and youth activity leagues and serving on boards for non-profit and healthcare facilities. Jim is an active member of the Lancaster Bar Association, having served as chairman to the workers’ compensation section, and is currently serving on the Board of the Lancaster Bar Association Foundation. In addition, he is a member of the Pennsylvania and American Bar Associations as well as various trial lawyer associations.
